Subscriber Standard Terms and Conditions
1. Definitions In the agreement, unless inconsistent or otherwise indicated by the context, the following terms shall bear the following meanings: 1.1 “APN” means Access Point Node. 1.2 “HSDPA” means High-Speed Downlink Packet Access. 1.3 “Your, you” means the subscriber who has subsribed. 1.4 “Subscriber” means the Online Direct PTY Ltd Subscriber who has access to HSDPA in accordance with these terms and conditions and as defined in the Online Direct PTY Ltd Subscriber Standard Terms and Conditions. 1.5 “PPU” means Pay-per-use as described and regulated by the Pay-per-use Terms and Conditions: (link to the PPU T’s and C’s to be made) 1.6 “VAS” means Online Direct Value Added Services.
2. General Terms and Conditions: 2.1 All the VAS will be available on HSDPA except Static IP 2.2 Your use of the HSDPA Service (the Service) is regulated by the terms and conditions below, which terms and conditions you consent to by making use of the Service. 2.3 Credit Vetting will be performed before a Subscriber is given access to the Service. 2.4 All prices include VAT. 2.5 You acknowledge that the GSM voice services are not accessible from the sim card provided with HSDPA. 2.6 The Subscriber must have a compatible HSDPA device to be able to use the Service. The device will be included in the 24 month contract options available from Online Direct PTY Ltd. 2.7 Data transfer speeds are not guaranteed and are dependant on network availability and utilization. 2.8 The Subscriber’s account will be pro rated and the data bundle will be pro rated. 2.9 All Subscribers will automatically be provisioned with PPU and the Subscriber may not opt out of PPU. 2.10 The Subscriber will be charged for the volume of data sent and received and not time spent online. 2.11 All unused in-bundle data will expire at the end of each and every month end this means that there is no data carry over. 2.12 Once the subscriber has used the Subscriber’s bundle, the prevailing out of bundle rates will apply. 2.13 SMS messages are charged at applicable standard rates or SMS bundled rates if applicable. 2.14 Utilisation of data is billed in units where each unit equals 1 byte. 2.15 Out of bundle (Pay-per-use) pricing is rounded off to the nearest cent. 2.16 Bundles and tariffs only apply to standard APN’s. 2.17 Online Direct PTY Ltd shall blacklist any stolen SIM card and prohibits any unlawful usage of SIM cards or unlawful activity in relation to HSDPA. 2.18 Tariffs do not apply to data roaming. 2.19 Upgrades during the 24 month contract period will be allowed and a notice period of (1) calendar month will be required. 2.20 All terms and conditions contained in Vodacom’s standard airtime agreement shall apply, these terms and conditions are available on www.iburst.co.za 2.21 An activation fee for the Service will be applicable and the amount of activation may vary from time to time. 2.22 Online Direct PTY Ltd accepts no liability for any loss or damage to the property or equipment of the Subscriber arising out of the provision, installation or maintenance of the Online Direct PTY Ltd HSDPA access service. 2.23 Booster Bundles expire 30 days after purchase 2.24 The Online Direct PTY Ltd Subscriber Standard Terms and Conditions apply in conjunction with these terms and conditions. 2.25 Subscriber is liable for any data usage that arises from the following: - Virus or spyware - Data used after theft of modem and sim - Charges from international roaming - Unexplained over utilization of bandwidth
